This Privacy Policy explains how WHapp collects, uses, stores and protects your personal information when you interact with our website or platform. It is prepared in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Please read it carefully.
1. Who we are
WHapp (World Health App) is a global healthcare technology platform. References to "WHapp", "we", "us" or "our" in this policy refer to WHapp and its operating entities. WHapp is an APP entity for the purposes of the Privacy Act 1988 (Cth). Our privacy contact is available at [email protected].
2. What personal information we collect
We may collect and hold the following kinds of personal information: • Identity information: name, title, professional credentials. • Contact information: email address, phone number, organisation name. • Usage information: pages visited, features used, device and browser information, IP address, and referral source. • Communications: messages you send us via our contact form or email. • Professional information: healthcare provider registration details, specialisation, and practice information where you register as a provider. Where practicable, we collect personal information directly from you. We do not collect sensitive health information about end users at this stage of the platform. If you do not provide the personal information we request, we may not be able to provide you with the relevant service or respond to your enquiry.
3. How we use your personal information
We use your personal information to: • Respond to enquiries submitted through our contact form. • Communicate with prospective providers, partners and investors. • Improve and develop the WHapp platform. • Comply with legal and regulatory obligations, including under Australian law. • Send relevant updates about the platform where you have provided consent. We will not use or disclose your personal information for a purpose other than the primary purpose of collection, unless an exception under the Privacy Act 1988 (Cth) applies or you have consented. Where we disclose personal information to overseas recipients, we take reasonable steps to ensure the recipient does not breach the Australian Privacy Principles in relation to that information, in accordance with APP 8.
5. Cross-border disclosure
WHapp operates globally. Your personal information may be transferred to and processed in countries outside Australia, including countries that may not have privacy laws equivalent to Australia's. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles your information in a manner consistent with the Australian Privacy Principles, as required by APP 8.1. By using our Platform, you acknowledge that such transfers may occur.
6. Data quality and security
We take reasonable steps to ensure that the personal information we hold is accurate, up to date, complete, and relevant, in accordance with APP 10. We implement appropriate technical and organisational security measures to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure, in accordance with APP 11. These measures include encryption, access controls, and secure data storage practices. However, no method of transmission over the internet is completely secure. Where personal information is no longer needed for any purpose, we will take reasonable steps to destroy or de-identify it.
7. Data retention
We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable Australian law. Contact form submissions are generally retained for up to 24 months. When personal information is no longer required, we take reasonable steps to destroy or permanently de-identify it in accordance with APP 11.2.
8. Your rights under the Australian Privacy Principles
Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the right to: • Access: request access to the personal information we hold about you (APP 12). • Correction: request correction of personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading (APP 13). • Anonymity: where lawful and practicable, interact with us without identifying yourself (APP 2). • Complain: lodge a complaint about a breach of the APPs. 9. Sensitive information
We do not currently collect sensitive information as defined under the Privacy Act 1988 (Cth), including health information, without your consent. As the WHapp platform develops and health-related features are introduced, we will update this policy and obtain appropriate consent before collecting any sensitive information.
10. Direct marketing
We will only use or disclose your personal information for direct marketing purposes if you have consented to receive such communications, in accordance with APP 7 and the Spam Act 2003 (Cth). All marketing communications will include a clear and functional unsubscribe mechanism. You may opt out at any time by contacting us at [email protected] or using the unsubscribe link in any communication.
11. Cookies
WHapp uses cookies and similar tracking technologies to understand how visitors use our site and to improve the user experience. You can control cookie preferences through your browser settings. We will provide a more detailed cookie policy as the platform develops.
12. Children
The WHapp platform is not directed at children under the age of 18. We do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact us immediately at [email protected] so we can take appropriate steps to delete it.
13. Notifiable data breaches
WHapp complies with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth). In the event of an eligible data breach that is likely to result in serious harm to affected individuals, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.
