Please read these Terms of Service carefully before using the WHapp website or platform. By accessing or using our services, you agree to be bound by these terms. These Terms are governed by the laws of New South Wales, Australia.

1. About WHapp

WHapp (World Health App) is a global healthcare technology platform operated by WHapp and its affiliated entities. These Terms of Service govern your access to and use of the WHapp website located at worldhealthapp.com and any related services, features, or content we make available (collectively, the "Platform").

2. Acceptance of terms

By accessing or using the Platform, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are accessing the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree to these Terms, you must not access or use the Platform.

3. Use of the platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not: • Use the Platform in any way that violates applicable Australian law or any other applicable local, national, or international law or regulation. • Transmit any unsolicited commercial electronic messages in breach of the Spam Act 2003 (Cth). • Attempt to gain unauthorised access to any part of the Platform or its related systems, in breach of the Criminal Code Act 1995 (Cth) or the Cybercrime Act 2001 (Cth). • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Platform. • Use the Platform to transmit harmful, offensive, or misleading content. • Engage in conduct that is misleading or deceptive in breach of the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). WHapp reserves the right to suspend or terminate access to the Platform for any user who violates these Terms.

4. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. If the Australian Consumer Law applies to a supply of goods or services under these Terms, and WHapp is in breach of a consumer guarantee, our liability is limited to (at our option): resupplying the services; or paying the cost of having the services resupplied.

5. Intellectual property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of WHapp or its licensors and is protected under the Copyright Act 1968 (Cth) and other applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Platform without our prior written consent.

6. Healthcare disclaimer

The Platform does not provide medical advice, diagnosis, or treatment. Content on the Platform is provided for informational purposes only and is not a substitute for professional medical advice from a registered health practitioner under the Health Practitioner Regulation National Law. Always seek the advice of your doctor or other qualified health provider with any questions you may have regarding a medical condition. In an emergency, call 000. WHapp does not facilitate the provision of clinical services at this stage of the platform.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy is prepared in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Please review our Privacy Policy at worldhealthapp.com/privacy.

8. Third-party links and services

The Platform may contain links to third-party websites or services that are not owned or controlled by WHapp. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and privacy policy of any third-party site you visit.

9. Limitation of liability

Subject to clause 4 (Australian Consumer Law) and to the fullest extent permitted by law, WHapp and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, resulting from: • Your access to or use of (or inability to access or use) the Platform. • Any conduct or content of any third party on the Platform. • Unauthorised access, use, or alteration of your transmissions or content. In no event shall WHapp's total liability to you exceed the greater of one hundred Australian dollars (AUD $100) or the amount you have paid to WHapp in the twelve months preceding the claim.

10. Disclaimer of warranties

Subject to clause 4 (Australian Consumer Law), the Platform is provided on an "as is" and "as available" basis. To the extent permitted by law, WHapp makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. WHapp does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Changes to the platform

WHapp reserves the right to modify, suspend, or discontinue the Platform (or any part of it) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

12. Changes to these terms

We may revise these Terms from time to time. The most current version will always be posted on this page with the effective date. By continuing to use the Platform after revisions become effective, you agree to be bound by the revised Terms.

13. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising under or in connection with these Terms, subject to any applicable mandatory consumer protection laws.
